Privacy Policy

L Frey Enterprises Pty Ltd, trading as Frey Health Group (ABN 69 667 303 639, ACN 667 303 639), cares about your privacy. In this policy, "we", "us" and "our" mean Frey Health Group. We run three services: Constellation Therapies, Grove Support Services and Frey Medical. This policy explains how we collect, use, share, store and protect your personal and health information.

We follow the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth). You can read the APPs on the website of the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

The information we collect

Personal information is information that identifies you. It includes your name, address, email, phone number and date of birth.

Health information is a type of sensitive information and has extra protection under the law. For us it can include your health history, symptoms, diagnoses, clinician notes, assessments and reports, referrals, care and support plans, appointment records, and details of your NDIS plan, Medicare or private health fund claims.

We collect information in a few ways: directly from you, over the phone, by email, through our website forms, and from people involved in your care where you have agreed. Where it is reasonable and practical, we collect it from you.

Why we collect it

We collect your information mainly to provide your care and support, to coordinate that care across our team, to manage bookings and billing, and to meet our legal and professional obligations. We may use it for a related second purpose that you would reasonably expect, such as service improvement or, with your consent, to send you updates.

Dealing with us anonymously

Due to the nature of the health services we provide, it is generally impracticable for us to deal with individuals who have not identified themselves. Accurate identification is required to ensure the safety and continuity of clinical care, to comply with our legal and professional obligations under applicable health legislation, and to meet the requirements of Medicare and private health insurance billing.

Sensitive and health information

We collect health and other sensitive information only with your consent, or where the law allows or requires it. We use it for the purpose you gave it to us, or for a directly related purpose you would reasonably expect.

Sharing information across our services

Frey Health Group runs Constellation Therapies, Grove Support Services and Frey Medical. With your consent, we may share relevant information between these services so your care is coordinated and you do not have to repeat your story to each team.

You can ask us not to share information between services. We will explain what that means for your coordinated care. We may also share information with others involved in your care, such as your GP or a support coordinator, where you have agreed or where the law allows.

Information we did not ask for

From time to time, we may receive personal or health information that we did not solicit. Where we receive unsolicited personal information, we will promptly assess whether that information is of a kind we could have collected under our standard collection practices.

Other disclosures

We may disclose your information where you consent, where the law requires or authorises it, or to trusted service providers who help us run our services (for example, secure cloud storage and practice-management software). We require these providers to protect your information.

Storing information overseas

Some of our service providers, such as secure cloud storage and software providers, may store information on servers located outside Australia. Where this happens, we take reasonable steps to make sure they handle your information in line with the Australian Privacy Principles.

Government identifiers

We do not use your Medicare number, NDIS number or other government identifiers as our own way of identifying you. We only use them for the purposes allowed by law, such as claiming or coordinating your funded care and supports.

Direct marketing

We will only send you marketing information if you have agreed to receive it. Every marketing message includes a simple way to opt out, and you can tell us to stop at any time by contacting us. We do not use your health information for marketing.

Cookies and our website

Our website may use cookies and similar tools to help it work and to understand how visitors use it. You can set your browser to refuse cookies, though some parts of the site may not work as well. We do not use your health information for website tracking.

Keeping your information safe

We store your information in a way that reasonably protects it from misuse, loss, and unauthorised access, change or disclosure. We use physical, electronic and staff-training measures to keep it secure.

How long we keep it

We keep clinical records for the minimum period the law requires. For an adult, this is generally at least 7 years from your last visit or contact. For a child, we generally keep records until they turn 25. These periods follow Queensland health-records requirements and the Privacy Act. When information is no longer needed, we destroy or de-identify it securely.

If there is a data breach

We follow the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act. If a breach is likely to cause you serious harm, we will notify you and the OAIC as soon as we can, and tell you what steps to take.

Access and correction

You can ask to see the information we hold about you and to correct it. We may ask you to verify your identity first. We will respond within a reasonable time. We do not charge to make a request, though a reasonable fee may apply for providing copies.
